The Host Manager is the intellectual property of Wickenheiser Enterprises. You must agree to this license to use The Host Manager.
Redistributing any files, or parts of files, is prohibited. Use of The Host Manager on more than one site without prior written permission from The Host Manager is prohibited. We reserve the right to prosecute to the full extent of the law for any violations.
All files are the intellectual property of The Host Manager.
LICENSE AGREEMENT
For the purposes of this agreement, "us" or "we" refers to The Host Manager and its owner, Wickenheiser Enterprises, and "you" refers to you, the client, any person or company you are representing, the end user of this product, as well as any person who comes in contact with the information and/or file(s) contained herein. "Software" refers to The Host Manager, including all files contained within the software.
All files are owned by us unless otherwise expressly agreed upon in writing with us. The software is licensed to you for use on one website for each unique license key provided to you.
You may not resell or redistribute the software.
The Host Manager, Wickenheiser Enterprises, its affiliates, owners, officers, directors, agents, subsidariaries, and employees are not responsible for any direct, indirect, or consequential damages, regardless of the use, nonuse, or misuse of any information, files, or software contained herein.
You agree to only use the software if you are in agreement with this license. You agree to provide accurate information to us when and where requested. You may not reverse engineer, decompile, or disassemble the software.
THE INFORMATION, FILES AND SOFTWARE ARE PROVIDED "AS IS" AND WITHOUT ANY WARRANTY, EXPRESS, IMPLIED OR STATUTORY. THE HOST MANAGER, WICKENHEISER ENTERPRISES, ITS AFFILIATES, OWNERS, DIRECTORS, AGENTS, SUBSIDARIES, AND EMPLOYEES DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some areas do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
IN NO EVENT WILL THE HOST MANAGER, WICKENHEISER ENTERPRISES, ITS AFFILIATES, OWNERS, DIRECTORS, AGENTS, SUBSIDARIES, OR EMPLOYEES BE LIABLE FOR LOST PROFITS, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OUR SITE, SERVICES, SOFTWARE, INFORMATION, OR FILES (HOWEVER ARISING, INCLUDING NEGLIGENCE).
OUR LIABILITY, AND THE LIABILITY OF THE HOST MANAGER, WICKENHEISER ENTERPRISES, ITS AFFILIATES, OWNERS, DIRECTORS, AGENTS, SUBSIDARIES, OR EMPLOYEES, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT PAID TO US, AND (B) $10 US DOLLARS. Some areas do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
YOU AGREE TO INDEMNIFY AND HOLD US, THE HOST MANAGER, WICKENHEISER ENTERPRISES, ITS AFFILIATES, OWNERS, DIRECTORS, AGENTS, SUBSIDARIES, AND EMPLOYEES HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING ATTORNEY FEES, MADE BY YOU OR ANY THIRD PARTY FROM THE USE OF INSTRUCTIONS, SOFTWARE, FILES, OR BREACH OF THIS AGREEMENT.
The Host Manager and/or Wickenheiser Enterprises has the right to suspend your license at any time, with or without cause.
Any violations of this license agreement may be prosecuted to the full extent of the law. All software intellectual property of Wickenheiser Enterprises. All rights reserved.
REFUND POLICY
Monthly subscriptions are not eligible for refunds. Installation services are not eligible for refunds.
All other purchases of The Host Manager software (excluding installation services) are eligible for a 90% refund within 3 days of purchase, or 50% within 15 days of purchase. The license key will be deactivated upon refund. Please contact sales@thehostmanager.com for additional details.
UPGRADE POLICY
For the first 12 months after purchase of a lifetime license you will receive free updates/upgrades. After this time you may elect to purchase an additional 12 months of updates at a price of $100 per year. Monthly licenses receive unlimited updates as long as the license is active.
